As you can see, the whole driver's side is sheared off, and our son really never had a chance. It is amazing the two friends with him were not seriously injured. What we cannot accept is the fact that somebody can do this type of damage and cause families this much grief and not even have to submit to a blood test to see if they should have been driving a vehicle in the first place. Let us know your opinion on the laws presently in place or the lack of laws pertaining to this type of situation, as we plan to submit a request for a change of the laws regarding this type of accident to local, regional, State and Federal agencies in the future. Hopefully, we will be able to get the laws changed to a mandatory testing of all parties involved in accidents of this nature and especially those involving fatalities or serious injuries.
Please keep your comments, ideas and suggestions related to the pertaining laws or lack thereof.
The following is an email received from a friend of our friend concerning the way an accident
of this type is handled in the State of Michigan. Connie is a parol officer for the State.
"I got the website of the kid who died from the accident. In Michigan, if they refuse a PBT at the
scene, a warrant will be processed and they would be taken to a hospital for a blood draw.
In any fatal accident in which the other driver is at fault, they can be charged with
Vehicular Manslaughter or Negligent Homicide, both 2 year felonies. Believe it or not,
I have two people on my case load for negligent homicide, both ran stop signs and plowed into another car.
Neither were drunk, but both got 1 year in jail and 5 years probation... for what its worth.”
